A close study of the constitutional conventions that founded eleven Western states, and of the constitutions they wrote, Democratic Beginnings traces the arc of Western development. Spanning the sixty years from California's constitution of 1850 to those of Arizona and New Mexico in 1910—and including Colorado, Idaho, Montana, Nevada, and Wyoming—Bridges shows how delegates to these states' constitutional conventions, pragmatically and creatively devised law and policy for the unprecedented challenges they faced. Far from the "island communities" of conventional 19th-century American history, these delegates, and the territories they represented, were thoroughly engaged in the central issues of their times, at the local, regional, and national levels—mining and agriculture, labor law and corporate responsibilities, water rights and government obligations, education and judicial practice.

Theirs was not the Founders' constitutional convention. With very different tasks, delegates more representative of the population, and the experience of living in a democratic republic that their forebears lacked, the Western delegates found unparalleled opportunities at the conventions for popular input into law and public policy. Amy Bridges is professor of political science and adjunct professor of history at University of California San Diego. She is the author of Morning Glories: Municipal Reform in the Southwest and A City in the Republic: Antebellum New York and the Origins of Machine Politics, 1828–1863.

Fascinating, Tantalizing, Frustrating

This book is fascinating, tantalizing, and frustrating, all at the same time.

It is fascinating because of the historical information and comparative analysis it provides on the history of western state constitutions and constitutional conventions. It is tantalizing because of passing comments and footnotes that hint of even more interesting information outside the book. It is frustrating because it is written by a political scientist for other political scientists.

The subject is the constitutions and constitutional conventions of the eleven states west of the Great Plains between 1849 and 1910. Twelve conventions are covered—California adopted its first constitution in 1848, and a second one in 1879. The author collects them in three groups for comparison: Antebellum (three conventions before and during the Civil War), the Gilded Age (seven between 1875 and 1895), and the Progressive Era (two in 1910). The conventions in each group are compared on several different policy subjects that vary from group to group (e.g. labor rights, water law, regulating corporations, direct democracy, etc.). They are also analyzed in terms of what kinds of people were elected to the conventions and what roles they played. In addition they are placed in context of the history, politics, and development of their states and the nation as a whole.

There is a wealth of information here for anyone interested in the history of the western states or in state constitutions and constitutional conventions in general. Unfortunately, anyone not familiar with the current academic political science literature in the area will find the book an uphill slog. For example, the author will discuss key players in a state convention and interject the name of another political scientist who has published something on the point she is making without identifying him as such. Unless you check the footnotes, you can’t be sure who is a delegate, and who is an academic. The book also suffers from the lamentable lack of good editing that has afflicted book publishing in recent years. Poor punctuation and occasional convoluted sentence structure make the book harder to read than necessary.

The title Democratic Beginnings: Founding the Western States promises much but falls short of what it promises. Nevertheless, for those who are truly interested in the topic, the effort is rewarding.

Western Constitutional Development Revisited

In this innovative and highly engaging work, Bridges (University of California, San Diego) analyzes the development of the founding state constitutional conventions and constitutions in the American West from 1850-1910. The creation of the constitutions of Arizona, California, Colorado, Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington, and Wyoming serve as the centerpiece of the study, which includes an emphasis on each state’s constitutional convention. The author posits that western constitutions “tried to assemble the best provisions and the modern understanding of equity and progress, for the constitutions they wrote” (p. 156). Unlike the federal constitutional convention, the delegates to the founding western state conventions were forced to respond to changing political environments, and new, previously unanticipated challenges (for example, irrigation and mining rights). Such deliberations often took place without the advantage of any legal or political precedent. The salutary role of state constitutional conventions in the development of western state constitutions is defended, and this constitutes a serious challenge to earlier scholarship. The explication of the state constitutional convention delegates’ diligence and statesmanship is of great importance to future studies of federalism and American political development.
